《劳动合同法》实施对我国企业人力资源管理的影响——基于人力资源经理的观点

THE IMPACT OF LABOR CONTRACT LAW'S ENFORCEMENT ONCHINESE ENTERPRISES' HUMAN RESOURCES MANAGEMENT——Based on the Perspectives of HR Managers

摘要: 《劳动合同法》对企业人力资源管理产生了重要影响。本文通过对全国近600家企业人力资源经理的调查,考察了《劳动合同法》实施前后企业在劳动合同签订率和合同期限、招聘、用人成本、解雇和经济补偿、用工灵活性等方面的变化情况。研究结果表明,《劳动合同法》明显提高了劳动合同签订率,延长了劳动合同期限,增加了无固定期限合同数量;促使招聘和解雇决策更谨慎;在一定程度上提高了用人成本,限制了用工灵活性。这些影响因企业规模、所有制不同而存在差异。

Abstract: Labor contract law has exerted great influence upon enterprises' human resources management.Based on the nationwide survey of almost 600 HR managers,this article investigated the changes of labor contract's signing rate and term,recruitment,labor cost,dismissal and economic compensation,labor flexibility before and after the enforcement of labor contract law.It showed that,the new law not only significantly raised the signing rate of contracts,extended the term of contracts,and increased the amount of non-fixed term labor contracts;but also caused the decisions of recruitment and dismissal more careful.Meanwhile it increased the labor costs and restricted the labor flexibility to some extent.Additionally,these impacts varied among enterprises with different size and ownership.
